1. Purpose
These terms govern the use of Talkieback, a service that lets a team collect voice and written feedback from the users of its applications and websites, read it and reply to it.
Talkieback is published by Red Brick Studio, sole proprietorship of Simon Gavelle (EI), 41 rue Jacquemars Giélée, 59800 Lille, France, SIRET 131 744 013 00015 ("Red Brick Studio"). The customer is the individual or legal entity that creates a Talkieback account for its applications or websites, for business purposes.
Creating an account constitutes acceptance of these terms and of the data processing agreement, which forms part of them.
2. The account
- Sign-in is passwordless, using a code sent to the person's email address. Each person remains responsible for access to their own mailbox.
- The account owner invites the members of their team and chooses their role: owner, admin or viewer. The customer is responsible for the actions of the people it invites.
- During the beta, opening an account may be limited to people who were invited.
3. Plans and prices
Prices are in euros. Red Brick Studio is under the VAT exemption scheme for small businesses: VAT not applicable, article 293 B of the French General Tax Code (CGI). Up-to-date details are on the pricing page.
| Plan | Price | Apps | Feedback per month | Retention |
|---|---|---|---|---|
| Free | €0 | 1 app | 15 | 30 days |
| Solo | €5 per month, or €48 per year | 1 app | 100 | 3 months |
| Pro | €39 per month, or €390 per year | 5 apps | 3,000 | 24 months |
| Business | €149 per month, or €1,490 per year | unlimited apps | 15,000 | 36 months |
- During the beta, a new account gets the Pro plan for free, with no credit card.
- After the beta, a new account starts with a 14-day trial of the Pro plan, with no credit card. At the end of the trial, if no plan has been chosen, the account moves to the Free plan.
- Payment is made by card, in advance, monthly or yearly, through Stripe. The subscription renews automatically until it is canceled.
- Beyond the monthly quota, feedback is kept but hidden on the Free and Solo plans, billed at €5 per 1,000 on the Pro plan, and billed at €3 per 1,000 on the Business plan.
- The customer may change plans at any time. When moving to a more expensive plan, the change is immediate and the price is prorated. When moving to a plan with a shorter retention period, feedback older than the new period is deleted after 30 days' notice.
- Red Brick Studio may change its prices: the customer is notified by email at least 30 days before its next renewal, and may cancel beforehand.
4. Use of the service
The customer:
- installs the button only in its own applications and websites, and declares their addresses or identifiers;
- informs its users, in particular by including in its privacy policy the clause that Talkieback provides;
- attaches to feedback only the information that is necessary, and no sensitive data, banking data or passwords;
- does not use the email addresses collected by Talkieback for marketing: they are used only to notify users of replies;
- does not use Talkieback to send unlawful content, or to interfere with the operation of the service (circumventing limits, automated bulk submissions).
Red Brick Studio may suspend an account that does not comply with these rules, after a warning, or immediately in the event of serious abuse or a security risk.
5. Personal data
- For feedback from the users of its apps, the customer is the controller and Red Brick Studio is the processor. The data processing agreement describes what Red Brick Studio does for the customer, its security measures and its own service providers.
- Users who send feedback are informed by the panel and by the privacy notice.
- For the customer's account data (team members, billing, service emails), Red Brick Studio is the controller, as described in the team privacy policy.
6. Availability and support
- Red Brick Studio does its best to keep Talkieback running without interruption, but cannot guarantee it. Maintenance is carried out outside peak hours whenever possible.
- During the beta, features may change or be withdrawn. The customer is notified in advance when they affect its data.
- Support is provided by email, at contact@redbrickstudio.fr. It is prioritized on the Business plan.
7. Ownership
- Talkieback, its code, its design and its brand belong to Red Brick Studio. The customer receives the right to use the service for the duration of its subscription.
- Feedback and replies belong to the customer and its users. Red Brick Studio uses them only to provide the service, as set out in the data processing agreement.
- On the Free and Solo plans, the "Powered by Talkieback" mention remains visible in the button and on the pages seen by users.
8. Liability
- Red Brick Studio is liable for direct damages caused by a breach of its obligations, up to the amounts paid by the customer during the 12 months preceding the damage.
- Red Brick Studio is not liable for indirect damages (loss of revenue, of customers, or of data of which the customer did not keep a copy), nor for the use the customer makes of feedback and of the tools it connects to Talkieback.
9. Term and termination
- The customer may cancel its subscription at any time from its account. The paid plan remains active until the end of the current period, without refund, except in the cases provided for in the data processing agreement.
- When the account is closed, the data remains available for export for 30 days, and is then deleted.
- Red Brick Studio may discontinue the service with 3 months' notice, and then refunds the paid and unused portion.
10. Changes
These terms may change. The customer is notified by email at least 30 days before a material change takes effect. If it does not accept the change, it may cancel before that date.
11. Governing law
These terms are governed by French law. In the event of a dispute, the parties first seek an amicable solution; failing that, the competent courts of Lille have jurisdiction.
